Just a day after his lawyer announced he would sue the City of Ferguson, Mo. and former police officer Darren Wilson, Dorian Johnson, a key witness in the Michael Brown shooting, was arrested.

According to CNN, Johnson was arrested for allegedly “discarding suspected narcotics on the ground” and interfering with an arrest. Charges have not been filed as of Thursday morning, St. Louis County Police spokeswoman Leah K. Freeman told the site.

Ferguson officials have yet to comment on the lawsuit, which seeks $25,000 in damages. In the suit, Johnson claims Wilson targeted him without probable cause, firing upon him and Brown as they ran away.

Brown was killed in the encounter. In documents released after a grand jury elected not to indict Wilson, the officer claimed Brown charged at him, prompting him to fear for his life.

Johnson is also suing Ferguson’s former police chief.

Ferguson spokesman Jeff Small said Wednesday that the city was aware of the lawsuit but declined to comment on pending litigation, CNN writes.
