EAST CLEVELAND, OH (WOIO) – Robert Starks has plenty to be thankful for this holiday season.

“I couldn’t believe it was happening,” Robert Starks.

He spent a month in jail after being accused of a 10-year-old rape he didn’t commit. Now that he’s back home, his family still can’t believe it.

“They just swooped him away from his family took him away from society stuck him in jail and said you did it,” Kimberly Phillips.

Despite the fact that Starks was the wrong guy, he was arrested and indicted by a county grand jury. He even had a series of pre-trial hearings.

Apparently, Robert has the exact same name of the real suspect. Once he was spotted on the streets, things got straightened out.

A court record shows personal information about the right guy and the wrong guy on the same page.
