A fan has filed a report with the NYPD alleging Cavs guard J.R. Smith took his phone and threw it into a New York City construction zone.

According to Bleacher Report, the altercation allegedly occurred when the fan asked to take a photo with the Cavs star.

Smith reportedly turned the man down, but the fan snapped a picture anyway, prompting the alleged altercation.

Smith’s attorneys have denied the report; however, police are investigating the incident.

The fan reported his $800 phone was damaged during the incident.
